Citations
Julie Ann Babikian
(Dana Point) - The Board issued an administrative citation that included a $500 civil penalty to Julie Ann Babikian, an unlicensed individual for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Babikian submitted a plan sheet to the City of Laguna Beach with a title block that stated "Intern Architect." Babikian paid the civil penalty satisfying the citation. The citation became effective on September 21, 2007.
Guy Bartoli
(Marina del Rey) - The Board issued an administrative citation that included a $1,500 civil penalty to Guy A. Bartoli, architect license number C-2568 (expired), for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that on or about May 3, 2004, while Bartoli's architect license was expired, he executed an "Agreement for Architectural Services" with a client to offer and provide services for a three unit condominium located in Redondo Beach, California. It was also alleged that Bartoli used letterhead which stated "Guy A. Bartoli Architect" and was listed under the "Architects" heading on the online telephone directory, "Smartpages.com." Bartoli paid the civil penalty satisfying the citation. The citation became effective on June 5, 2006.
Scott James Bauchman
(El Cajon) - The Board issued an administrative citation that included a $500 civil penalty to Scott James Bauchmann, architect license number C-23382, for a violation of Business and Professions Code section 5584 (Negligence). The action was taken based on evidence that Bauchmann failed to perform the project in a timely manner, he departed from the standard of practice, and failed to provide adequate communication and records throughout the course of the project. The citation became effective on October 1, 2004.
Val John Belli
(Santa Cruz) - The Board issued an administrative citation that included a $2,000 civil penalty to Val John Belli, architect license number C-21838, for violations of Business and Professions Code sections 5536.22(a)(3), (4), and (5) and 5584 (Negligence). The action was taken based on evidence that Belli failed to: 1) include statutorily required language in a written contract when providing professional services to a client; 2) investigate existing conditions concerning the second floor framing and address the serious impact of the conditions; 3) provide a required site plan for the building site approval; and 4) obtain preliminary approvals and provide accurate information to the client concerning the status of project. Belli paid the civil penalty satisfying the citation. The citation became effective on October 15, 2004.
Rodolfo Billedo
(San Pablo) - The Board issued an administrative citation that included a $1,000 civil penalty to Rodolfo Billedo, an unlicensed individual, for violations of Business and Professions Code (BPC) sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). The action was taken based on evidence that Billedo entered into a contract to prepare drawings for a "new structure and addition to existing structure" and ".would include work areas, toilets, kitchen, parking spaces and reception area." This is a non-exempt project. The citation became effective on June 2, 2005.
Matthew Bolak
(Belmont) - The Board issued an administrative citation that included a $2,000 civil penalty to Matthew Bolak, dba Caspian Builders, an unlicensed individual, for violations of Business and Professions Code section 5536(a) (Practice Without License or Holding Self Out as Architect). The action was taken based on evidence that Bolak executed a written contract to provide "Architecture, Planning Geotechnical and Civil Engineering" for a project. The contract described the architectural services that would be provided and listed the fees for "Architectural Design and Working Drawings." The contract contained a signature line stating, "Matthew Bolak Architect." Bolak put out a business card stating, "Matthew Bolak, AIA Principal Architect." Bolak's vehicle had a sign on the door stating that Caspian Builders provides, "Architecture Engineering Construction." The citation became effective on November 15, 2004.
Bruno Bondanelli
(Los Angeles) - The Board issued an administrative citation that included a $500 civil penalty to Bruno Bondanelli, architect license number C-29801 for alleged violations of BPC sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). The action alleged that on or about October 7, 1998, Bondanelli executed a written agreement to provide design and construction observation services on two single-family, non-exempt homes; one of which was three stories and the other was four stories. Bondanelli was not issued an architect license until June 29, 2004. Bondanelli paid the civil penalty satisfying the citation. The citation became effective on January 26, 2006.
David Charles Brewer
(Santa Ana) - The Board issued an administrative citationthat included a $500 civil penalty to David Charles Brewer, an unlicensed individual, foralleged violations of BPC section 5536(a)(Practice Without License or Holding Self Outas Architect). The action alleged that Brewer's Web site, www.creative-groups.com, stated that he specializes in "Architectural Design."In addition, Brewer's title block on plans for aproject stated "Architecture & Civil Engineering." The citation became effective on April 9, 2007.
Bill Brobisky
(Concord) - The Board issued an administrative citation that included a $1,000 civil penalty to Bill Brobisky, an unlicensed individual, for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Brobisky put out a business card which included the word "Architecture" and had a listing under the "Architects" heading at "Smartpages.com" on the Internet. The citation became effective on November 30, 2006.
Malka Bussmann
(Los Angeles) - The Board issued an administrative citation that included a $1,500 civil penalty to Malka Bussmann, an unlicensed individual, for alleged violations of BPC section 5536(a)(Practice Without License or Holding Self Out as Architect). The action alleged thatBussmann executed an agreement to provide "Architectural Services." The agreement was on letterhead which identified her firm as "The Art of Architecture." Bussmann also put out invoices which identified her as an "Architecture Designer" and "Architectural Designer." The citation became effective on November 1, 2007.
Lee Porter Butler
(West Palm Beach, Florida) - The Board issued an administrative citation that included a $500 civil penalty to Lee Porter Butler, an unlicensed individual, for a violation of Business and Professions Code section 5536(a) (Practice Without a License or Holding Self Out as Architect). This action was taken based on evidence that Mr. Butler made a verbal agreement to a client to provide architectural design services for a property located in California. Mr. Butler received a cash payment from the client and acknowledged in writing that payment was received for architectural services. The citation became effective on February 27, 2004.
Mark Byrnes
(Oceanside) - The Board issued an administrative citation that included a $1,000 civil penalty to Mark Byrnes, architect license number C-23413, for alleged violations of Business and Professions Code (BPC) section 5536.22(a) (Written Contract). The action alleged that Byrnes commenced providing professional services without an executed written contract. In an unrelated project, Byrnes failed to include in the contract his license number, a description of the procedure that the architect and the client will use to accommodate additional services, and a description of the procedure to be used by either party to terminate the contract. Byrnes paid the civil penalty satisfying the citation. The citation became effective on September 22, 2006.
Howard Cameron
(Piedmont) - The Board issued an administrative citation thatincluded a $500 civil penalty to HowardCameron, an unlicensed individual, for analleged violation of BPC section 5536(a)(Practice Without License or Holding Self Outas Architect). The action alleged that Cameronsubmitted a cost proposal to his client offering"Architectural" redesign services for a residence. The citation became effective on April 23, 2007.
Richard M. Camponuevo
(Daly City) - The Board issued an administrative citationthat included a $1,000 civil penalty to RichardM. Camponuevo, an unlicensed individual, foralleged violations of BPC sections 5536(a)(Practice Without License or Holding Self Outas Architect) and 5536.1(c) (UnauthorizedPractice). The action alleged thatCamponuevo offered to prepare and preparedconstruction plans for a three-story residence,which is not a building described in BPC sec-tion 5537(a) as an exempt building. The citationbecame effective on February 2, 2007.
Victor Candare Canales
(San Francisco) - The Board issued an administrative citation that included a $500 civil penalty to Victor Candare Canales, architect license number C-12553, for an alleged violation of BPC section 5536.22(a) (Written Contract). The action alleged that Canales commenced providing professional services for a residence without an executed written contract. Canales paid the civil penalty satisfying the citation. The citation became effective on August 8, 2006.
Charles Creighton Carlin
(San Francisco) - The Board issued an administrative citation that included a $500 civil penalty to Charles Creighton Carlin, architect license number C-24561, for an alleged violation of BPC section 5584 (Willful Misconduct). This action alleged that Carlin failed to return an overpayment to a design builder in a joint venture agreement. The citation became effective on September 22, 2006.
Luis M. Carrillo
(Pico Rivera) - The Board issued an administrative citation that included a $500 civil penalty to Luis M. Carrillo, an unlicensed individual, for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Carrillo submitted plans to the City of San Bernardino Building Department with a title block that stated "Carrillo Architectural Design." The citation became effective on September 12, 2006.
Jay Scott Charles
(Santa Monica) - The Board issued an administrative citation that included a $1,000 civil penalty to Jay Scott Charles, an unlicensed individual, for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Charles was listed on the Internet under the "Architects" heading on Allpages.com, Hellosantamonica.com, Merchantcircle.com, and Michaelgreenwald.com. In addition, Charles' invoices included a charge for an "Architectural Fee" and his firm was identified as "JSC Architects." The citation became effective on August 14, 2007.
Victor Chu
(Los Angeles) - The Board issued an administrative citation that included a $500 civil penalty to Victor Chu, architect license number C-10488, for an alleged violation of BPC section 5536.22(a) (Written Contract). The action alleged that Chu failed to include statutorily required language in a written contract, which resulted in a dispute. Chu paid the civil penalty satisfying the citation. The citation became effective on November 13, 2006.
William Alexander Coffroth
(Sacramento) - The Board issued an administrative citation that included a $2,000 civil penalty to William Alexander Coffroth, architect license number C-13842, for alleged violations of BPC section 5584 (Willful Misconduct). The action alleged that Coffroth did not pay his engineering consultants in a timely manner; therefore, the consultants withheld work pending payment for past invoices, which resulted in project delays, consequential contract termination, and monetary damage to the client. Coffroth executed an addendum to his written agreement with the client agreeing to provide proof of his errors and omissions insurance. He later admitted that he did not have insurance and did not intend to obtain it unless the client agreed to continue the project and not retain another architect. Coffroth paid the civil penalty satisfying the citation. The citation became effective on May 30, 2007.
David Neal Colombo
(Santa Rosa) - The Board issued an administrative citation that included a $500 civil penalty to David Neal Colombo, architect license number C-20167, for a violation of BPC section 5584 (Negligence and/or Willful Misconduct). The action was taken based on evidence that Colombo executed a written agreement to provide architectural services for a garage and living area addition to a residence and received a retainer from the client for $1,245. Colombo failed to provide the plans as agreed and failed to return the client's telephone calls, abandoning the project. The citation became effective on October 12, 2005.
Patrick Wiley Conover
(Irvine) The Board issued an administrative citation that included a $3,500 civil penalty to Patrick Wiley Conover, architect license number C-12807, for alleged violations of BPC sections 5536.1(b) Signature and Stamp on Plans and Documents), 5536.22 (Written Contract), 5582.1 (Signing Other's Plans or Instruments), and 5584 (Negligence) and California Code of Regulations (CCR) section 135(d) (Association). The action alleged that upon taking over a project from an unlicensed individual, Conover failed to provide a copy of the Agreement of Association by certified mail to the Board; failed to place the legend "Licensed Architect" on his stamp; stamped and signed plans not prepared by him, which he knew to be deficient causing the client financial damage; and failed to execute a written contract with the client to provide architectural services. Conover paid the civil penalty satisfying the citation. The citation became effective on May 30, 2007.
Rick Conroy
(Temecula) - The Board issued an administrative citation that included a $3,000 civil penalty to Rick Conroy, an unlicensed individual, for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Conroy executed a "Custom Architecture and Interior Design Agreement" to provide architectural design services for the remodel of a residence. The contract stated that it is "Made between Newport Architects, represented by Rick Conroy." The contract was on letterhead that stated "Newport Architects" and described the architectural services that would be provided. The signature line for the contract stated "Rick Conroy - Newport Architects" and was signed by Conroy. Conroy prepared a "Preliminary Cost Analysis" on letterhead that stated "Newport Architects" and contained a signature block that stated "Rick Conroy Newport Architects." Conroy put out a business card stating "Newport Architects" and "Rick Conroy Principal." Conroy is a member of the Temecula Valley Chamber of Commerce (Chamber). The Chamber has a Business Directory with a heading titled "Architects." The listing stated "Newport Architects, Inc." with Conroy's name. Conroy also executed a written agreement with clients to provide architectural services for an auto body project in Murrieta, California. The agreement stated "The contract is made between Newport Architects, hereafter referred to as 'Architect'." Conroy signed the contract above the signature line stating "Newport Architects." Conroy paid the civil penalty satisfying the citation. The citation became effective on April 17, 2006.
Renato Corzo
(Pasadena) - The Board issued an administrative citation that included a $500 civil penalty to Renato Corzo, an unlicensed individual for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Corzo prepared plans for two single- family dwellings. The plans contained title blocks which stated "Corzo Associates" and "Architects & Planners." Corzo paid the civil penalty satisfying the citation. The citation became effective on April 18, 2006.
Gary D. Crouse
(South Lake Tahoe) - The Board issued an administrative citation that included a $500 civil penalty to Gary D. Crouse, architect license number C-13796, for a violation of BPC section 5584 (Willful Misconduct). This action was taken based on evidence that Crouse abandoned the project by failing to provide plans as agreed and failing to return the client's telephone calls regarding the project. The citation became effective on June 28, 2005.
James Cutler
(Bainbridge Island, WA) The Board issued an administrative citation that included a $2,000 civil penalty to James Cutler, an unlicensed individual for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Cutler executed an "AIA Document B151 - 1997 Abbreviated Standard Form of Agreement Between Owner and Architect" to provide design services for a residence located in Bodega, California. The agreement described the architect's responsibilities and scope of architect's basic services to be provided. Cutler signed his name above the title "ARCHITECT." Cutler also prepared a listing titled "Construction Documents" with a heading stating "Cutler Anderson Architects" and prepared an "AIA Document A101-1997 Standard Form of Agreement Between Owner and Contractor," stating that he was the "Architect" on the agreement. Cutler's contract documents for the project included title blocks and a cover sheet of the Project Manual, which stated "Cutler Anderson Architects." The citation became effective on August 20, 2007.
Administrative Actions
Louis Wayne Alves
(Redding) - Effective October 21, 1998, Louis Wayne Alves' architect license #C-10855 was revoked after the Board adopted a Default Decision ordering revocation. An Accusation was filed against Mr. Alves pursuant to Business and Professions Code sections 5584 (Willful Misconduct and Negligence), 5585 (Recklessness), and 5586 (Public Agency; Disciplinary Action). The action was taken based on evidence that Mr. Alves failed to adequately supervise or review the work of his employees prior to signing documents prepared by them in the production of asbestos management plans. Mr. Alves was certified as an Asbestos Consultant by Cal/OSHA and represented that his architectural firm was able to provide asbestos consulting services. Mr. Alves contracted with the Pierce Joint Unified School District to perform an Asbestos Hazard Emergency Response Act inspection of their facilities and to develop an asbestos management plan to enable the school district to manage the asbestos in the schools and to meet federal guidelines for asbestos abatement. As a result of his conduct, Mr. Alves was served with disciplinary action by the Environmental Protection Agency (EPA) for violation of the Toxic Substances Control Act. Mr. Alves never responded to the complaint and the EPA filed a default order fining him $56,000.
Janice Marie Ambry
(Los Angeles) - A Statement of Issues was filed against Janice Marie Ambry to deny her Application for Licensure for violations of Business and Professions Code section 5536 (Practice Without License or Holding Self Out as Architect). The action against Ms. Ambry was based on evidence that she engaged in the unlawful practice of architecture, advertised and offered to provide architectural services and unlawfully prepared plans and affixed a stamp to plans which indicated to the public that she was licensed by the State of California as an architect. In March 1985, Ms. Ambry was issued an architect license. On September 30, 1987, the license expired and was not renewed. The Board's investigation revealed that after Ms. Ambry's license expired, she: 1) signed employment verification forms under the penalty of perjury indicating that she was licensed as an architect and that the applicants were under her direct supervision performing architectural duties; 2) advertised in the Santa Monica yellow page telephone directory under the heading "architects"; 3) signed and stamped construction documents for a residence indicating that she was a "Licensed Architect" and bearing the legend "State of California"; and 4) used letterhead and business cards which stated "Ambry and Associates Residential Architecture and Planning." The Board adopted a stipulated settlement effective October 21, 1998. The terms of the settlement included a license be granted to Ms. Ambry and she be placed on probation for five years with specific terms and conditions, including payment of a civil penalty in the amount of $1,150 and reimburse the Board $7,000 for investigative costs.
Garo Giragos Babikian
(Laguna Niguel) - Garo Giragos Babikian's architect license #C-9865, was revoked effective November 16, 2000, after the Board adopted a Proposed Decision by an Administrative Law Judge. The decision also ordered Mr. Babikian to reimburse the Board $4,712.50 for its reasonable costs of investigation and enforcement. An Accusation was filed against Mr. Babikian for violations of Business and Professions Code section 5536 (Practice Without a License or Holding Self Out as an Architect) and section 5577 (Conviction of Certain Crimes). Mr. Babikian's license expired on December 31, 1995 and was not renewed until December 28, 1999. The Accusation was based on evidence that while Mr. Babikian's license was expired, he held himself out as an architect and offered and provided architectural services. The Board's investigation revealed that: 1) On or about April 23, 1998, he received $950 from a client to begin repair on the roof of her home. He also used the term "architect" or "architecture" on his letterhead and business card. Mr. Babikian did not begin the repairs on the roof nor did he return the client's money and 2) On or about April 16, 1998, he received $12,000 to provide architectural services for the design and construction of an automotive repair shop. In addition, he used the term "architect" on his proposal and contract with the client. Mr. Babikian did not complete the project, nor did he return the client's money.
As a result of the Board's investigation, a six-count criminal misdemeanor complaint was filed in the Alhambra Judicial District Municipal Court on April 1, 1999. On June 8, 1999, Mr. Babikian pled nolo contendere to conducting business as an architect without a license. Imposition of sentence was suspended and he was placed on three years formal probation with terms and conditions requiring him to make restitution of $12,950 and ordering him not to contract without a business license.
Mr. Babikian filed a Petition for Writ of Mandate in Superior Court, appealing the Board's decision to revoke his license. On August 7, 2001, the Superior Court denied Mr. Babikian's appeal, thus upholding the Board's revocation of his license.
Craig Allen Bower
(Paso Robles) - A Statement of Issues was filed against Craig Allen Bower, an unlicensed individual and candidate for licensure, after he appealed the Board’s denial of his application for licensure. The denial was based on evidence that Mr. Bower had disciplinary action taken against him by a public agency for an act substantially related to the qualifications, functions, or duties of an architect, in violation of section 5586 of the Business and Professions Code. A stipulated settlement and disciplinary order was negotiated and adopted by the Board. The terms and conditions of the stipulation included the issuance of architect license number C-31539, which was immediately revoked, the revocation stayed, and Mr. Bower was placed on five years’ probation.
Gordon Wayne Calhoon
(Encino) - Effective July 24, 1999, Gordon Wayne Calhoon's architect license #C-11576 was revoked after the Board adopted a Stipulation in Settlement ordering revocation. An Accusation was filed against Mr. Calhoon for violations of Business and Professions Code sections 5583 (Fraud in the Practice of Architecture), 5584 (Negligence or Willful Misconduct) and 5586 (Public Agency; Disciplinary Action). Mr. Calhoon was hired as an architect and contractor to demolish and rebuild residences that were damaged by the 1994 Northridge earthquake. Board action was taken based on evidence that Mr. Calhoon falsely represented that, as an architect, he could act as a contractor. After getting the projects, Mr. Calhoon acted as a contractor (without being appropriately licensed) and failed to adequately supervise the construction, resulting in a material injury to both homeowners. He used an unlicensed contractor to supervise construction, and approved work which he knew did not comply with relevant building codes. The Contractors State License Board issued a citation to Mr. Calhoon based on evidence that he provided contracting services prior to being issued a license.
