Citations
David Daniel
(San Diego) - The Board issued an administrative citation that included a $1,000 civil penalty to David Daniel, an unlicensed individual, for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Daniel's business card included the term "Architecture" in the business name. In addition, Daniel's firm Aldrin Architecture & Design, Inc. had an advertisement in the San Diego Home/Garden Lifestyles magazine. Daniel was listed on the Internet under the "Architects" heading on Merchantcircle.com and Superpages.com. Daniel also stated during a meeting with a client that "Aldrin is a onestop shop, Title 24 calculations, structural engineering, civil engineering, landscape architecture, and architectural services;" and that he was a licensed architect with several years of experience and a member of The American Institute of Architects. The citation became effective on August 14, 2007.
Peter Robert Davis
(Carmel) - The Board issued an administrative citation that included a $500 civil penalty to Peter Robert Davis, architect license number C-21300, for an alleged violation of BPC section 5536.22(a) (Written Contract). The action alleged that Davis commenced providing architectural services for a mixed-use building and applied for a Use Permit through the City on behalf of his client, without an executed written contract. The citation became effective on April 26, 2006.
Philip James Debolske
(Los Angeles) - The Board issued an administrative citation that included a $500 civil penalty to Philip James Debolske, architect license number C-14694, for a violation of BPC section 5584 (Negligence). The action was taken based on evidence that Debolske failed to meet the standard of practice and care by preparing inadequate and incomplete drawings for submission to the Los Angeles City Planning Department and the Historical Preservation Overlay Zone Architectural Review Committee. Debolske paid the civil penalty satisfying the citation. The citation became effective on November 3, 2005.

Van Nuys) - The Board issued an administrative citation that included a $250 civil penalty to Oscar A. Ensafi, an unlicensed individual, for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Ensafi put out a business card which stated that he provides "Architectural Plans." Ensafi paid the civil penalty satisfying the citation. The citation became effective on November 6, 2007.
Jerrod Langston Ewell
(Pacifica) - The Board issued an administrative citation that included a $500 civil penalty to Jerrod Langston Ewell, an unlicensed individual, for a violation of Business and Professions Code section 5536(a) (Practice Without License or Holding Self Out as Architect). This action was taken for misrepresentation based on evidence that Ewell put out a billing invoice with his name and the term "Architecture" on it. Ewell paid the civil penalty satisfying the citation. The citation became effective on June 16, 2004.
Milton Ewell
(Los Angeles) - The Board issued an administrative citation that included a $1,500 civil penalty to Milton Ewell, an unlicensed individual, for violations of Business and Professions Code section 5536(a) (Practice Without License or Holding Self Out as Architect). The action was taken based on evidence that Ewell identified himself as "a very qualified, experienced architect.," and as a "Project Architect" on a fax cover sheet to a prospective employer. The fax also included a copy of a stamp which read "LICENSED ARCHITECT," "MILTON EWELL," "No. C13106" (an invalid number), "EXPIRATION 6/30/01," and the legend "STATE OF CALIFORNIA." The citation became effective on November 11, 2004.
Vernon G. Fergel
(Riverbank) - The Board issued an administrative citation that included a $500 civil penalty to Vernon G. Fergel, an unlicensed individual, for violations of Business and Professions Code section 5536(a) and (b) (Practice Without a License or Holding Self Out as Architect). This action was taken based on evidence that while his license was expired, Mr. Fergel prepared plans which bore a title block that read "Vernon G. Fergel Architect." The plans bore a stamp that read "Licensed Architect," "Vernon G. Fergel," No. C11766," "12-31-03 Renewal Date," the legend "State of California," and his signature. Mr. Fergel paid the civil penalty satisfying the citation. The citation became effective on October 23, 2003.
Stephen Joseph Fiduk
(Fountain Valley) - The Board issued an administrative citation that included a $500 civil penalty to Stephen Joseph Fiduk, architect license #C-22623, for a violation of Business and Professions Code section 5584. This action was taken based on evidence that Mr. Fiduk failed to prepare preliminary documents in compliance with zoning regulations. Mr. Fiduk paid the civil penalty satisfying the citation. The citation became effective May 12, 2004.
Raul Figeroa
(Garden Grove) - The Board issued an administrative citation that included a $3,000 civil penalty to Raul Figueroa, an unlicensed individual, for violations of BPC sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). The action was taken based on evidence that Figueroa signed a Food Construction Plan Application Form for the Los Angeles Department of Health Services that identified him as the architect for a meat market (a non-exempt project); entered into a contract, which identified him as the architect, to prepare plans for a new taco stand structure (a non-exempt project); and entered into a contract, which identified him as the architect, to design and prepare construction documents for a hall for rent with kitchen facilities and new restrooms (a nonexempt project). The citation became effective on August 10, 2005.
Lee Ann Fleming
(Tustin) - The Board issued an administrative citation that included a $500 civil penalty to Lee Ann Fleming, architect license #C-26795, for a violation of Business and Professions Code section 5536.22 (Written Contract). This action was taken based on evidence that Ms. Fleming entered into an agreement on May 7, 2003, which identified her as the "Architect," to provide landscaping services. The agreement stated "..the Drawings and Specifications prepared by the Architect, dated April 29, 2003.." Ms. Fleming commenced preparing these drawings and specifications without having an executed written contract for professional services. Ms. Fleming paid the civil penalty satisfying the citation. The citation became effective on January 26, 2004.
Kuanin Fong
(San Francisco) - The Board issued an administrative citation that included a $500 civil penalty to Charles Creighton Carlin, architect license number C-24561, for an alleged violation of BPC section 5584 (Willful Misconduct). This action alleged that Carlin failed to return an overpayment to a design builder in a joint venture agreement. The citation became effective on September 22, 2006.
Raymond Eugene Fox
(San Diego) - The Board issued an administrative citation that included a $1,000 civil penalty to Raymond Eugene Fox, architect license number C-24583, for alleged violations of BPC section 5536.22(a) (Written Contract). The action alleged that Fox commenced providing professional services to develop medical offices without an executed written contract. Fox paid the civil penalty satisfying the citation. The citation became effective on September 19, 2006.
Eric Corey Freed
(San Francisco) - The Board issued an administrative citation that included a $500 civil penalty to Eric Corey Freed, architect license number C-30731 for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that prior to licensure, Freed maintained a Web site www.organicarchitect.com, which stated "Promoting both an organic and individual approach to design, architect, author and educator Eric Corey Freed." The Web site indicated that Freed provided "Architecture." A review of several Web site addressesrevealed that Freed was named as an "Architect," an "Organic Architect," and a "Green Architect." Freed paid the civil penalty satisfying the citation. The citation became effective on June 28, 2006.
John Benjamin Friedman
(West Hills) - The Board issued an administrative citation that included a $100 civil penalty to John Benjamin Friedman, architect license number C-9167, for a violation of BPC section 5536.22 (Written Contract). The action was taken based on evidence That Friedman provided a complete set of architectural drawings for a restaurant without executing a written contract. The citation became effective on May 26, 2005.
Administrative Actions
Steven A. Elmore
(Santa Cruz) - Effective July 24, 1999, Steven A. Elmore's architect license #C-10809 was revoked; however, the revocation was stayed, his license was suspended for 90 days, and he was placed on probation for five years with specific terms and conditions, including reimbursing the Board $4,272 for investigative costs. An Accusation was filed against Mr. Elmore for violations of Business and Professions Code section 5536 (Practice Without License or Holding Self Out as Architect). On December 31, 1991, Mr. Elmore's license expired and was not renewed until December 31, 1996. The action was taken based on evidence that in November 1993 and June 1994, he entered into contracts to perform architectural services. On March 29, 1995, Board staff informed him that his license had expired, and that he was prohibited by law from practicing and/or representing himself as an architect until he renewed his license. On April 5, 1995, he contacted the Board and indicated that he would promptly mail his renewal fee, but failed to do so. In November 1995, the Board received information that he signed an architectural contract to design a house.
Convictions
Leandre Davis
(San Jose) - LeAndre Davis, 37, was sentenced to 87 months in prison and ordered to pay $1.17 million restitution for fraud schemes stemming from the 1994 Northridge earthquake. Mr. Davis was president of Shadowbrook Design Group, which was retained by Allstate Insurance Co. to provide engineering services following the quake. The case was the result of an investigation by the Board, Department of Consumer Affairs, and the FBI and resulted in the September 2000 conviction by a Los Angeles federal jury on 26 criminal counts related to three fraud schemes. The first scheme involved preparing false and misleading engineering reports that Allstate used to settle claims for policyholders whose property was damaged in the quake. Mr. Davis falsely represented that he was an architect in the reports. In addition, reports were prepared with inadequate inspection and in some cases were prepared and used to settle claims when no architect or engineer had inspected the policyholder's property.
