Citations

Charles Dewey Garland

(Cathedral City) - The Board issued an administrative citation that included a $500 civil penalty to Charles Dewey Garland, architect license #C-11991, for a violation of Business and Professions Code section 5536.22 (Written Contract). This action was taken based on evidence that Mr. Garland commenced preparing drawings for a patio cover for a residence without having an executed written contract for professional services. The citation became effective on January 27, 2004.

(Cathedral City) - The Board issued an administrative citation that included a $1,000 civil penalty to Charles Dewey Garland, architect license number C-11991, for violations of BPC sections 5536.22(a) (Written Contract) and 5584 (Negligence). This action was taken based on evidence that Garland commenced providing architectural services without an executed written contract and produced a freehand sketch of a new beam and adjacent walls for the project that was below the standard of practice for architecture. Garland paid the civil penalty satisfying the citation. The citation became effective on October 4, 2005.

Timothy Edmond Good

(Diamond Bar) - The Board issued an administrative citation that included a $500 civil penalty to Timothy Edmond Good, architect license number C-7956, for a violation of Business and Professions Code section 5584 (Willful Misconduct) and California Code of Regulations section 150 (Willful Misconduct). The action was taken based on evidence that Good failed to meet two schedules issued to the client with milestones to achieve completion of the project. He provided no updates or justification for schedule changes and/or delays to the client during the process. Good paid the civil penalty satisfying the citation. The citation became effective on September 30, 2004.

Jon Green

(Sacramento) - The Board issued an administrative citation that included a $1,000 civil penalty to Jon Green, an unlicensed individual, for alleged violations of BPC sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). The action alleged that Green offered to prepare "architectural drawings" and prepared construction documents for a non-exempt project. In addition, construction documents for this project identified Green as an architect. Green paid the civil penalty satisfying the citation. The citation became effective on July 11, 2006.

Campbell Grey

(Bear Valley Springs) - The Board issued an administrative citation that included a $1,000 civil penalty to Campbell Grey, an unlicensed individual, for alleged violations of BPC sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). The action alleged that Grey offered to prepare and then prepared preliminary drawings for a three-story residence, which is not a building described in BPC section 5537(a) as an exempt building. The citation became effective on August 14, 2007.

Edward Gulian

(Long Beach) - The Board issued an administrative citation that included a $2,500 civil penalty to Edward Gulian, an unlicensed individual, for alleged violations of BPC sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). The action alleged that Gulian prepared plans for commercial buildings with a title block that stated "Gulian Design Architecture." On the cover sheet to the plans for the projects, under the list of "Consultants," Gulian is identified as the "Architect" and has the designation "A.I.A." following his name. Gulian paid the civil penalty satisfying the citation. The citation became effective on October 10, 2006.

Marvin Gustafson

(Santa Barbara) - The Board issued an administrative citation that included a $1,000 civil penalty to Marvin Gustafson, an unlicensed individual, for violations of Business and Professions Code section 5536(a) (Practice Without License or Holding Self Out as Architect). Gustafson prepared plans for a project that bore a title block that read "Gustafson & Associates" and "Architectural Design." Gustafson's letterhead stated "Gustafson & Associates" and "Architectural Design." The citation became effective on October 27, 2004.

David Edward Haltnunen

(Vista) - The Board issued an administrative citation that included a $500 civil penalty to David Edward Halttnunen, architect license number C-14503, for an alleged violation of BPC section 5584 (Negligence). The action alleged that Halttnunen failed to communicate with his clients and failed to proceed with their project in a timely manner. This resulted in monetary damage to the clients and caused them to terminate his services and hire a design-build firm to complete the project. Halttnunen paid the civil penalty satisfying the citation. The citation became effective on October 16, 2006.

Norman F. High

(San Simeon) - The Board issued an administrative citation that included a $1,500 civil penalty to Norman F. High, architect license number C-17140, for alleged violations of BPC 5536.22(a) (Written Contract), 5584 (Willful Misconduct) and CCR 160(c)(2) (Rules of Professional Conduct). The action alleged that High failed to include statutorily required language in his written contract; failed to disclose his financial relationship with the contractor in writing to the client; and cashed a payment check prior to building department approval, which was contrary to the contract. High paid the civil penalty satisfying the citation. The citation became effective on September 28, 2007.

William Gene Holcomb

(Santa Fe) - The Board issued an administrative citation that included a $500 civil penalty to William Gene Holcomb, architect license #C-13684, for a violation of Business and Professions Code section 5584 (Willful Misconduct). This action was taken based on evidence that Mr. Holcomb executed a written agreement with a client to provide residential remodel services. The client became dissatisfied with Mr. Holcomb's services, terminated the contract, and requested a refund. Mr. Holcomb and the client executed a written agreement that mediated the dispute involving the client's termination of the contract for professional services and demand for a refund of the fees that had been paid to Mr. Holcomb. Mr. Holcomb paid the first of 20 installment payments, then failed to pay the remainder. Mr. Holcomb's failure to pay the client pursuant to a written agreement constituted willful misconduct. The citation became effective on February 9, 2004.

Miguel Ibarra

(Anaheim) - The Board issued an administrative citation that included a $500 civil penalty to Miguel Ibarra, an unlicensed individual, for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Ibarra submitted a Design Review Application to the City of Claremont in which he identified himself as an architect. The citation became effective on August 14, 2007.

Toshiro Isa

(Gardena) - The Board issued an administrative citation that included a $500 civil penalty to Toshiro Isa, architect #C-12392, for a violation of Business and Professions Code section 5536.22 (Written Contract). This action was taken based on evidence that Mr. Isa commenced preparing conceptual drawings for apartment units without having an executed written contract for professional services. Mr. Isa paid the civil penalty satisfying the citation. The citation became effective on December 29, 2003.

Administrative Actions

Ronald Anthony Giddings

(Alameda) - Effective January 20, 2006, Ronald Anthony Giddings' architect license number C-18887 was revoked. The action was the result of a Default Decision, which was adopted by the Board.

An Accusation was filed against Giddings for alleged violations of Business and Professions Code (BPC) sections 5583 (Fraud in Practice of Architecture) and 5584 (Willful Misconduct). The Accusation alleged that Giddings entered into a contract to provide architectural services for a residential addition and remodel. The subject received a retainer in the amount of $500 and two original drawings of the floor plan for the property. The subject failed to provide any architectural services on the project and failed to return the $500 retainer and original drawings. In another project, the subject entered into a contract to provide architectural services and secure permits related to a residential addition and remodel. The subject failed to provide the necessary plans for the project to enable the City of Alameda to issue permits to complete the project. The clients were required to hire another architect to complete the architectural plans at a cost of $4,289.55.

Andrew Paul Goetz

(Newport Beach) - Andrew Paul Goetz pled guilty to 13 felony counts in Orange County Superior Court, and was sentenced to 60 days in jail, three years of probation, and immediate surrender of his architect's license, for forging or altering land surveys. The Board sought to revoke Goetz's license after he admitted in January 2005 that he forged or altered land surveys on more than a dozen homes in Newport Beach. Goetz, who had been licensed in California as an architect since 1987, did not contest the revocation, which went into effect June 16, 2005, and has surrendered his license. The case was the result of an investigation by the Board and the Newport Beach Police Department.

Richard Jay Hornberger

(Orinda) - Richard Jay Hornberger's architect license #C-11773, was suspended for 90 days for violations of Business and Professions Code sections 5582 (Aiding Unlawful Practice) and 5582.1 (Signing Other's Plans or Instruments and Permitting Misuses of Name). The Board's action was prompted by Mr. Hornberger aiding and abetting an unlicensed person in the offering and performance of architectural services, and signing and stamping plans that were not prepared under his supervision.

Mr. Hornberger's license was suspended for 90 days and he was placed on five years probation with specific terms and conditions, effective April 11, 1998.

Charles Scott Hughes

(Arlington, VA) - On November 30, 1998, the Court of Appeal of the State of California Third Appellate District ruled that the California Architects Board did not impose an excessive sanction when it revoked the architect's license of Charles Scott Hughes in July 1993. The Court concluded that the discipline imposed by the Board was well within its discretion and affirmed the revocation. Mr. Hughes was disciplined by the Board for deceptive acts he committed before he received his California license.

In February 1990, Mr. Hughes applied for an architect's license in California. He said he had never been convicted of a crime; in a supplemental filing the next month, he mentioned the Virginia charge but said it had already been dropped. He passed the required examination and was licensed in September 1990.

In 1991, the Board learned that Mr. Hughes had done the following: 1) substituted the certificate of registration of another architect and falsely stated on the AIA application that he was registered as an architect in the District of Columbia since 1977; 2) falsely stated on his resume that he was a graduate of the University of Virginia and a registered architect in Maryland, Virginia, and the District of Columbia; and 3) used the stamps or certificates issued to other architects on architectural plans that he personally had prepared in or about 1986. The Board filed disciplinary charges against Mr. Hughes in 1992 and in 1993 his licensed was revoked based on this misconduct.

On appeal, the case was heard in January 1998, by the California Supreme Court to determine whether or not the Board had the authority to discipline licensed architects for pre-licensure misconduct. On March 26, 1998, the Court ruled that the Board had the authority to discipline licensed architects for pre-licensure misconduct. The Court returned the case to an appellate court to decide whether revoking Mr. Hughes' license was excessive punishment. The appellate court concluded that the Board's revocation of Mr. Hughes' license was not excessive punishment.

Convictions

Bernard Haynes, Jr.

(Rialto) - On September 19, 1997, Bernard Haynes, Jr. was arrested and charged with Penal Code section 529 (False Personation of Another in Private; a felony) and Business and Professions Code section 5536 (Holding Self Out as an Architect and Practice Without a License, a misdemeanor). On March 3, 1998, in the County of San Bernardino Superior/Municipal Courts, pursuant to a plea bargain, Business and Professions Code section 5536 was dismissed and Mr. Haynes was convicted of Penal Code section 529. Mr. Haynes has been placed on supervised probation for a period of 36 months on the following terms and conditions: serve 60 days in a San Bernardino County Jail Facility, make restitution to victims in the amount of $8,321.50, and $200 to the State Restitution Fund.

The felony charge was based on evidence that Mr. Haynes of A & B Design Group had been forging the signature and using the license number and stamp of a licensed architect on various projects in California. Mr. Haynes had also submitted to the Board a change of address for the licensed architect and proceeded to pay his renewal fees. Mr. Haynes had an office with the name on the window of A & B Design Group and the words "Architecture-Planning-Interiors." Inside the office were business cards stating the same and on the wall was the certificate of the licensed architect. A & B Design Group was also listed in the GTE Yellow Page Directory under the heading, "Architects." In addition, Mr. Haynes' actions caused a lien to be placed on the licensed architect's credit report by the Franchise Tax Board with regard to a project performed by Mr. Haynes.
