Citations

Brian L. Johnston

(Vacaville) - The Board issued an administrative citation that included a $500 civil penalty to Brian L. Johnston, architect license number C-7059, for a violation of BPC section 5584 (Negligence). This action was taken based on evidence that Johnston failed to obtain timely approval of a gas station expansion project and failed to complete the construction documents in a timely fashion. Johnston paid the civil penalty satisfying the citation. The citation became effective on August 9, 2005.

(Vacaville) - The Board issued an administrative citation that included a $550 civil penalty to Brian L. Johnston, architect license number C-7059, for alleged violations of BPC section 5536.22(a) (Written Contract). The action alleged that Johnston failed to include statutorily required language in a written contract for providing professional services for a single family residence. Johnston also commenced providing professional services for a remodel of a convenience store without an executed written contract. Johnston paid the civil penalty satisfying the citation. The citation became effective on June 12, 2006.

Timothy Patrick Jones

(Chula Vista) - The Board issued an administrative citation that included a $500 civil penalty to Timothy Patrick Jones, architect license #C-24012, for a violation of Business and Professions Code section 5536.22 (Written Contract). This action was taken based on evidence that Mr. Jones commenced preparing drawings for an addition to a residence without having an executed written contract for professional services. Mr. Jones paid the civil penalty satisfying the citation. The citation became effective on January 15, 2004.

Simon Karkafi

(Los Angeles) - The Board issued an administrative citation that included a $1,500 civil penalty to Simon Karkafi, an unlicensed individual, for alleged violations of BPC sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). The action alleged that Karkafi offered to prepare and prepared construction plans for six four-story condominiums, which are not buildings described in BPC section 5537(a) as exempt. In addition, the construction drawings identified Karkafi's company, Eurocon Group, Inc., as the "Architect." Karkafi paid the civil penalty satisfying the citation. The citation became effective on March 26, 2007.

Woon Hae Kim

(Orange) - The Board issued an administrative citation that included a $500 civil penalty to Woon Hae Kim, expired architect license number C-7507, for violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). This action was taken based on evidence that on August 27, 2004, while Kim's architect license was expired, he signed an Employment Verification Form indicating that he was licensed as an "Architect" in California, and used his expired license number "7507" and a false expiration date of "March 28, 2005." Kim paid the civil penalty satisfying the citation. The citation became effective on June 20, 2005.

Terence Hayhing Kwok

(Monterey Park) - The Board issued an administrative citation that included a $750 civil penalty to Terence Hayhing Kwok, architect license number C-24796, for a violation of BPC section 5536.22(a) (Written Contract). This action was taken based on evidence that Kwok provided architectural services for a math clinic tutoring center without executing a written contract. Kwok paid the civil penalty satisfying the citation. The citation became effective on August 10, 2005.

Roy Stanley Latka

(San Francisco) - The Board issued an administrative citation that included a $500 civil penalty to Roy Stanley Latka, architect license number C-7256, for violation of BPC section 5583 (Deceit). This action was taken based on evidence that Latka and his firm entered into a contract with the State of California to provide services for the expansion of a state hospital. A security consultant/systems engineer submitted a proposal to the firm for its portion of the work, and this proposal was included in the firm's proposal, which the state approved. Latka and the firm then advised the consultant/systems engineer that they had to reduce their fees due to negotiations with the state and pressured them for lower fees to enable successful negotiations. The consultant/systems engineer reduced their fees twice at Latka and his firm's advisement. Latka and his firm were deceitful in dealing with the consultant/systems engineer, falsely claiming that the state was forcing a reduced bid, after Latka and his firm had already been awarded the contract. Latka paid the civil penalty satisfying the citation. The citation became effective on October 19, 2005.

Greg Lekosis

(Los Angeles) - The Board issued an administrative citation that included a $500 civil penalty to Greg Lekosis, architect license number C-29129, for an alleged violation of BPC section 5584 (Negligence). The action alleged that Lekosis terminated his Agreement of Association with an unlicensed person and failed to properly notify the clients in writing that he was no longer the architect of record on their project. Lekosis paid the civil penalty satisfying the citation. The citation became effective on March 5, 2007.

Gunther Liedl

(Beverly Hills) - The Board issued an administrative citation that included a $1,000 civil penalty to Gunther Liedl, an unlicensed individual for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Liedl used a business card and letterhead which stated "Liedl & Associates, Architects/Engineers, Corp." and "Forensic Architecture." The citation became effective on June 12, 2007.

Robert Lloyd Linnaus

(Laguna Hills) - The Board issued an administrative citation that included a $750 civil penalty to Robert Lloyd Linnaus, architect license number C-18713, for alleged violations of BPC 5536.22(a)(Written Contract) and 5584 (Willful Misconduct). The action alleged that Linnaus failed to include statutorily required language in a written contract for providing professional services, and he failed to complete the work that he was paid to do by not responding to the plan corrections checklist. The citation became effective on May 30, 2007.

Administrative Actions

Darrell James Jackson

(Yreka) - Effective May 18,1999, Darrell James Jackson 's architect license #C-11555 was revoked. The revocation came after a stipulated settlement was negotiated and adopted in what the Board considers it an extreme case of negligence associated with life-safety issues.

Mr. Jackson admitted in a Board-adopted settlement that, as the architect in general responsible charge at the Dorris Elementary School construction project, he had been negligent by failing to perform the duties required of an architect in general responsible charge, and that the manner in which the school was constructed required that it be condemned and demolished.

Mr. Jackson was hired by the Butte Valley Unified School District in Siskiyou County to serve as the architect in charge of building a new elementary school in Dorris. The Board had alleged that due to Mr. Jackson 's negligence, the performance of the inspector, various consultants, and contractors was allowed to fall below acceptable standards in a number of areas. Specifically, the Board alleged 180 individual and separate instances of errors, omissions, and violations of law had been committed in the school 's construction.

As a result of the numerous building code violations, the school failed to meet the Division of State Architect 's structural, seismic, fire and life safety code requirements. Dorris Elementary School was condemned, demolished, and rebuilt at a cost of $4 million. Approximately 250 students who attended the school from December 1991 to August 1993 were displaced.

Admissions by Mr. Jackson that his conduct constituted negligence within the meaning of Business and Professions Code section 5584 and agreement to reimburse the Board $15,000 for costs related to investigation, expert evaluation, and prosecution of the case were also terms of the stipulated settlement.

Fred Juco

(Vacaville) - Effective December 28, 2005, Fred Juco's architect license number C-12006 was revoked; however, revocation was stayed and Juco was placed on probation for five years with specific terms and conditions, including reimbursing the Board $3,172.50 for its investigative and prosecution costs. The action came after a stipulated settlement was negotiated and adopted by the Board.

An Accusation was filed against Juco for alleged violations of Business and Professions Code (BPC) sections 5536.1 (Signature and Stamp on Plans and Documents; Unauthorized Practice), 5536.22 (Written Contract), and 5584 (Negligence or Willful Misconduct). The Accusation alleged that Juco failed to sign or affix a seal to plans he prepared for a project, he failed to include statutorily required language in a written contract when providing professional services to a client, and he was negligent in the management of the construction on a project.

Arthur Frank Kent

(Huntington Beach) - Effective April 27, 2007, Arthur Frank Kent's architect license, number C-15748, was revoked; however, revocation was stayed, his license was suspended for 150 days and he was placed on probation for six years with specific terms and conditions, including reimbursing the Board $8,000 for its investigative and prosecution costs. The action came after a stipulated settlement was negotiated and adopted by the Board.

An Accusation was filed against Kent for alleged violations of Business and Professions Code (BPC) sections 5583 (Fraud in Practice of Architecture), 5584 (Negligence or Willful Misconduct), and 5536.22 (Written Contract). The Accusation alleged that Kent submitted an altered soils report with building plans to the City of Huntington Beach (City) for his client's project, when the soils report was actually for a different project and property. Kent did not prepare or execute a written contract for this project.

In another project, Kent was hired to provide architectural drawings to add an overhang on the front entryway of a residence. The plans that Kent submitted to the City did not pass plan check. The plans were redone, resubmitted and approved. After the work was completed, water started leaking into the home from the roof and because of improper drainage, water started to pool on the roof. There was potential water and mold damage to the interior drywall and attic. The City performed a final inspection, issuing a Corrections Notice that the roof pitch must meet the Building Code requirements, regardless of the architect's plans. Kent corrected the plans twice and those plans still did not meet the City's approval. Four months later, the City approved Kent's plans. Subsequently, the contractors refused to work on the project stating that the plans were still incorrectly done. Kent did not prepare or execute a written contract for this project.

Hawk Lee

(San Francisco) - Effective July 30, 2004, Hawk Lee's architect license #C-25780 was revoked; however, the revocation was stayed, his license was suspended for 180 days and he was placed on probation for five years with specific terms and conditions, including reimbursing the Board $3,000 for its investigation and enforcement of the case. The action came after a stipulated settlement was negotiated and adopted by the Board.

An Accusation was filed against Lee for alleged violations of Business and Professions Code sections 5536.22 (Written Contract), 5582 (Aiding and Abetting), 5582.1 (Signing Other's Plans or Instruments) and 5585 (Incompetency or Recklessness). The Accusation alleged that Lee affixed his stamp and signature to plans which were prepared by a person not authorized to practice architecture, affixed his signature to plans which were not prepared by him or under his responsible control, and failed to execute a contract with his client.
