Citations
Troyer Scott MacGillivray
(Los Angeles) - The Board issued an administrative citation that included a $500 civil penalty to Troyer Scott MacGillivray, architect license number C-9504, for a violation of BPC section 5536.22 (Written Contract). The action was taken based on evidence that MacGillivray commenced providing architectural services without an executed written contract. The subject appealed the citation and both an informal conference and an administrative hearing was held. A proposed decision submitted from the Administrative Law Judge was received by the Board affirming the citation. The Board voted to adopt the proposed decision except that due to mitigating circumstances, the proposed penalty was reduced from $500 to $50. MacGillivray paid the civil penalty satisfying the citation. The citation became effective on April 29, 2005.
Eduardo Manuel Martinez
(San Jose) - The Board issued an administrative citation that included a $1,500 civil penalty to Eduardo Manuel Martinez, architect license number C-11558, for a violation of BPC section 5584 (Willful Misconduct). This action was taken based on evidence that Martinez failed to pay for engineering services, which he contracted for and were provided to him, concerning a project for the California Department of Parks and Recreation (DPR). Martinez billed the DPR for services provided by the engineering firm and there is no evidence that he was not paid, however, he failed to pay the engineering firm. The citation became effective on October 4, 2004.
Jose Martinez
(Chula Vista) - The Board issued an administrative citation that included a $2,500 civil penalty to Jose Martinez, an unlicensed individual, for alleged violations of Business and Professions Code sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). The action alleged that Martinez forged an architect’s signature and affixed an architect’s stamp to the drawings which read: “Licensed Architect,” “a licensee’s name and license number,” “Exp. 02-28-09,” and the legend “State of California.” In addition, the project is described as converting a house into a warehouse/office. A change in occupancy requires documents prepared for this project to be signed by a licensed design professional; therefore, this project is not a building described in BPC section 5537(a) as an exempt building. The citation became effective on February 26, 2008.
Connie Maxwell
(San Francisco) - The Board issued an administrative citation that included a $1,000 civil penalty to Connie Maxwell, an unlicensed individual for violations of Business and Professions Code sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). This action was taken based on evidence that Maxwell executed a written agreement to provide architectural services and prepared plans for a townhouse unit consisting of 19 dwellings. Maxwell paid the civil penalty satisfying the citation. The citation became effective on June 29, 2004.
Raul Mayorga
(Van Nuys) - The Board issued an administrative citation that included a $500 civil penalty to Raul Mayorga, an unlicensed individual, for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Mayorga executed a written contract to provide "Architectural Drafting" work for the remodel of a residence. The contract stated that "architectural drawings" will be prepared and described the "Architectural work" that would be provided. The citation became effective on June 27, 2006.
Steven Patrick John McGinty
(Fresno) - The Board issued an administrative citation that included a $1,500 civil penalty to Steven Patrick John McGinty, architect license number C-23640, for violations of Business and Professions Code sections 5536(a) and (b) (Practice Without a License or Holding Self Out as Architect) and 5536.1(c) (Stamp Requirement). This action was taken based on evidence that while McGinty's license was expired, he entered into a contract and he prepared plans for a bed and breakfast inn, which is a commercial, non-exempt project. In addition, he affixed or caused to be affixed to the plans, a stamp which appeared to be his except the license number shown was not his. The plans contained a title block which in part stated "STEVEN McGINTY ARCHITECTS." The citation became effective on May 24, 2004.
John William McMurray
(Laguna Beach) - The Board issued an administrative citation that included a $2,000 civil penalty to John William McMurray, architect license number C-6223, for alleged violations of BPC sections 5536.22(a) (Written Contract) and 5584 (Negligence). The action alleged that McMurray entered into written contracts with the Army Navy Academy to provide architectural design for two dormitory buildings. The contracts did not contain McMurray's license number. He changed code-compliant windows to non code-compliant windows, misinterpreted the Building Code and caused financial damage to the client in the amount of $382,325.51. McMurray failed to seek and obtain written approval from the City for these changes, which is the standard of practice. McMurray paid the civil penalty, satisfying the citation. The citation became effective on April 9, 2007.
Roseanne Clark McNulty
(San Francisco) - The Board issued an administrative citation that included a $1,500 civil penalty to Roseanne Clark McNulty, architect license #C-15277, for violations of Business and Professions Code sections 5536(a) and (b) (Practice Without a License or Holding Self Out as Architect) and 5536.1(b) (Stamp Requirement). This action was taken based on evidence that while Ms. McNulty's license was expired, she prepared plans, and affixed and signed a stamp which read "REGISTERED ARCHITECT," "ROSEANNE McNULTY," "C-15277," the handwritten date on which the stamp was affixed, and the legend "STATE OF CALIFORNIA," for the renovation of nine buildings to be used as affordable housing, which are commercial, non-exempt projects. Also, Ms. McNulty's stamp did not contain a means of indicating the renewal date of her license and listed "REGISTERED ARCHITECT" on her stamp rather than the mandated legend "licensed architect." In addition, while Ms. McNulty's architect license was expired, she signed an Employment Verification Form indicating that she was licensed as an "Architect" in California with the license number"15277" and an expiration date of "04."Ms. McNulty paid the civil penalty satisfying the citation. The citation became effective on January 14, 2004.
Raymond Medak
(San Pedro) - The Board issued an administrative citation that included a $750 civil penalty to Raymond Medak, architect license number C-21755, for violations of Business and Professions Code sections 5536.22 (Written Contract) and 5584 (Negligence). The action was taken based on evidence that Medak's contract did not contain a description of the procedure to be used by either party to terminate the agreement, and he failed to perform services for which he was contracted. Medak paid the civil penalty satisfying the citation. The citation became effective on November 5, 2004.
Boguslaw Megiel
(Valencia) - The Board issued an administrative citation that included a $500 civil penalty to Boguslaw Megiel, architect license number C-25783, for an alleged violation of BPC section 5536.22(a) (Written Contract). The action alleged that Megiel commenced providing professional services, and submitted invoices to the client for said services, without an executed written contract. The citation became effective on July 25, 2006.
Thomas L. Murphy
(Los Angeles) - The Board issued an administrative citation that included a $1,000 civil penalty to Thomas L. Murphy, architect license number C-16590, for violations of BPC sections 5536.22(a) (Written Contract) and 5584 (Negligence). This action was taken based on evidence that Murphy commenced providing architectural services without an executed written contract; provided plans that were deficient in quality and completeness, so that they were unable to be approved through plan check; failed to complete plans; and abandoned the project. Murphy paid the civil penalty satisfying the citation. The citation became effective on October 11, 2005.
James R. Newmeyer
(Placerville) - The Board issued an administrative citation that included a $1,500 civil penalty to James R. Newmeyer, architect license number C-9842, for alleged violations of BPC section 5584 (Negligence). The action alleged that under the standards of practice and care, Newmeyer failed to base the site grading and drainage system plan on either his own demonstrable expertise or the report of a civil or geotechnical engineer; failed to get written authorization from the owner/client for additions or changes to the plans; and failed to notify the prior architect of record of any changes to the plans. The citation became effective on October 9, 2007.
David C. Nguyen
(San Jose) - The Board issued an administrative citation that included a $500 civil penalty to David C. Nguyen, an unlicensed individual, for violations of Business and Professions Code section 5536(a) (Practice Without a License or Holding Self Out as Architect). This action was taken based on evidence that Mr. Nguyen executed a standard form of agreement wherein he offered to provide architectural services and identified himself as an "Architect." The citation became effective on October 3, 2003.
(San Jose) - The Board issued an administrative citation that included a $1,000 civil penalty to David C. Nguyen, an unlicensed individual, for violations of Business and Professions Code section 5536(a) (Practice Without a License or Holding Self Out as Architect). This action was taken based on evidence that Mr. Nguyen executed a standard form of agreement wherein he offered to provide architectural services and identified himself as an "architect." In addition, on the standard form of agreement, Mr. Nguyen identified himself as "Mr. David C. Nguyen A.I.A." and "David C. Nguyen A.I.A. #390203754." The citation became effective on February 27, 2004.
Kim Nga Nguyen
(Milpitas) - The Board issued an administrative citation that included a $1,000 civil penalty to Kim Nga Nguyen, an unlicensed individual, for alleged violations of BPC sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). This action alleged that Nguyen prepared construction documents for a non-exempt dwelling. In addition, Nguyen gave the client a business card that identified her as an "Architectural Designer." The citation became effective on January 16, 2007.
Tuan Jonathan Nguyen aka Jonathan Ngo
(Fountain Valley) - The Board issued an administrative citation that included a $1,000 civil penalty to Tuan Jonathan Nguyen aka Jonathan Ngo, an unlicensed individual, for alleged violations of BPC sections 5536(a) and (b) (Practice Without License or Holding Self Out as Architect). The action alleged that Nguyen affixed a stamp to plans that read "LICENSED ARCHITECTURE & CONSULTING," "ICM Co.," "No. 706869," "Exp. 5-31-05," "CONSULTANT," and the legend "STATE OF CALIFORNIA." In addition, the plans contained a title block that stated "Architecture & Consultant." Nguyen paid the civil penalty satisfying the citation. The citation became effective on October 2, 2006.
Robert Lane Noble
(Encinitas) - The Board issued an administrative citation that included a $250 civil penalty to Robert Lane Noble, architect license number C-21574, for a violation of BPC section 5536.22(a)(3), (4), and (5) (Written Contract). This action was taken based on evidence that Noble provided a proposal to provide architectural services for a 34-unit hotel. The proposal did not contain Noble's license number, a description of the procedure that the architect and the client would use to accommodate additional services, or a description of the procedure to be used by either party to terminate the contract. A significant fee dispute with the client was aggravated by Noble's failure to include the written procedure that the architect and client would use to accommodate additional services. The citation became effective on October 26, 2005.
Robert M. Noguera
(Los Angeles) - The Board issued an administrative citation that included a $500 civil penalty to Robert M. Noguera dba Design Master USA & Co., Inc., an unlicensed individual, for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect.) The action alleged that Noguera executed a "Contract Form: DMUSA - 04 Design Master USA & Co., Inc. & Client Agreement" with a client to provide services to design a new residence. The contract contained a listing, "Services to be Rendered by Design Master USA" and indicated that "Architectural Planning" would be provided. The citation became effective on March 23, 2007.
Kenneth L. O'Connor
(Jenner) - The Board issued an administrative citation that included a $1,000 civil penalty to Kenneth L. O'Connor, an unlicensed individual, for violations of Business and Professions Code section 5536(a) (Practice Without a License or Holding Self Out as Architect). This action was taken based on evidence that Mr. O'Connor's title block identified his business name as "Architecture in Evolution" and a letter from him included the designation of "Architect" under his name. The citation became effective on October 15, 2003.
Jerry Oldknow
(San Mateo) - The Board issued an administrative citation that included a $1,500 civil penalty to Jerry Oldknow, an unlicensed individual, for violations of Business and Professions Code section 5536(a) (Practice Without a License or Holding Self Out as Architect). This action was taken based on evidence that Oldknow offered to provide "architectural design" for a non-exempt project. Mr. Oldknow also affixed and signed an architect stamp belonging to an architect licensed in California, without the architect's permission. In addition, Mr. Oldknow's company, Oldknow and Associates, was listed in the 2001 Pacific Bell Smart Yellow Pages under the architects' heading. Mr. Oldknow paid the civil penalty satisfying the citation. The citation became effective on March 22, 2004.
Bruce Gregory Oveson
(Vacaville) - The Board issued an administrative citation that included a $500 civil penalty to Bruce Gregory Oveson, an unlicensed individual, for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Oveson submitted a resume to BSB Design in El Dorado Hills, California. Oveson’s resume stated that he holds an architect license in California. BSB hired Oveson on April 11, 2005, with the understanding that he was a licensed architect in California. Oveson’s California architect license had expired on November 30, 1997, and was not renewable. The citation became effective on March 17, 2008.
Administrative Actions
Lance C. O'Donnell
(Palm Springs) - A Statement of Issues was filed against Lance C. O'Donnell, an unlicensed individual and candidate for licensure, after he appealed the Board's denial of his application for licensure. The denial was based on evidence that Mr. O'Donnell had represented himself as an architect, in violation of Business and Professions Code section 5536(a) (Holding Self Out as Architect). A stipulated settlement was negotiated with Mr. O'Donnell when he admitted to the allegations and acknowledged that there was cause for imposing discipline. The terms and conditions of the stipulation was effective March 7, 1998 and included the issuance of a license which was immediately revoked, the revocation was stayed, and Mr. O'Donnell was placed on three years' probation and required to reimburse the Board $2,765 for its investigative costs.
