Citations
Thomas Navarre Perry
(San Diego) - The Board issued an administrative citation that included a $1,000 civil penalty to Thomas Navarre Perry, architect license number C-24874, for violations of Business and Professions Code sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). The action was taken based on evidence that while Perry's licensed was expired, he entered into a contract to report on soil subsidence and excessive moisture/ ventilation issues, and to provide working drawing for code violation corrections. He identified himself as "Thomas Perry Archtiect" on the report and on two contracts he executed. The citation became effective on January 31, 2005.
Scott Peterson
(Antioch) - The Board issued an administrative citation that included a $1,500 civil penalty to Scott Peterson, an unlicensed individual, for violations of Business and Professions Code sections 5536(a) (Practice Without a License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice; Misdemeanor). This action was taken based on evidence that Mr. Peterson provided two clients with a proposal for services that identified the name of his company as "Scott Peterson Design/Architecture." In another proposal for services, on a non-exempt project type, Mr. Peterson listed the services to be provided under the heading, "RESPONSIBILITY OF THE ARCHITECT" and listed his compensation under "Architectural Fees." The citation became effective April 26, 2004.
Tuan H. Pham
(Irvine) - The Board issued an administrative citation that included a $500 civil penalty to Tuan H. Pham, an unlicensed individual, for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Pham entered into a written contract for a tenant improvement project. In the contract, Pham listed the fees for "Architectural Services." The citation became effective on December 15, 2006.
Alan Pinel
(Pasadena) - The Board issued an administrative citation that included a $500 civil penalty to Alan Pinel dba AlpineDesign, an unlicensed individual, for analleged violation of BPC section 5536(a)(Practice Without License or Holding Self Out as Architect). The action alleged that Pinel's Web site, www.puravidateam.com/AlpineDesign/alpinedesign revealed that his firm provides "Architectural Design" and"Architectural Plans." The citation became effective on February 20, 2007.
Edward W. Powell
(Redondo Beach) - The Board issued an administrative citation that included a $1,000 civil penalty to Edward W. Powell, architect license number C-27775, for alleged violations of BPC section 5584 (Negligence). The action alleged that Powell's plans for the design of a residence were below the acceptable standards for architectural practice and the timeframe of the work was longer than customary for a project of this scope. Powell also failed to complete the construction documents for landscape design services for the rear yard of a residence, as required in the contract. Powell paid the civil penalty satisfying the citation. The citation became effective on June 23, 2006.
Jess Real
(Manteca) - The Board issued an administrative citation that included a $500 civil penalty to Jess Real, an unlicensed individual, dba Real Design Studio, for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Real offered and provided plans for a 12-unit townhouse, which is not described in BPC section 5537(a) as an exempt building. The citation became effective on September 12, 2006.
Kurt Monroe Reinkens
(Truckee) - The Board issued an administrative citation that included a $500 civil penalty to Kurt Monroe Reinkens, architect license number C-24517, for a violation of Business and Professions Code section 5536.22 (Written Contract). This action was taken based on evidence that Reinkens provided design, architectural, and permitting services for a luxury custom residence, without having an executed written contract for professional services. Reinkens paid the civil penalty satisfying the citation. The citation became effective on February 14, 2005.
Ralph Resendez
(Merced) - The Board issued an administrative citation that included a $500 civil penalty to Ralph Resendez, an unlicensed individual, for a violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action was taken based on evidence that Resendez entered into a contract to prepare drawings for four stair enclosures; front and side remodel; lobby extension; and trash enclosure for a motel, which is a nonexempt project. The citation became effective on June 2, 2005.
Alejandro Resendiz
(Montclair) - The Board issued an administrative citation that included a $1,000 civil penalty to Alejandro Resendiz, architect license number C-11660, for violations of BPC sections 5536(a) and (b) (Practice Without License or Holding Self Out as Architect), and 5536.1(c) (Unauthorized Practice). Resendiz's architect license expired on October 31, 2001 and was not renewed until July 23, 2004. The action was taken based on evidence that while Resendiz's license was expired, he submitted plans to the building department which included a stamp that read "REGISTERED ARCHITECT," "ALEJANDRO RESENDIZ," "C-11660," "Exp. 10-31-04," and the legend "STATE OF CALIFORNIA." Resendiz also prepared plans for a medical clinic, which is a non-exempt project, while his license was expired. The citation became effective on June 2, 2005.
Timothy Rhoads
(Corona Del Mar) - The Board issued an administrative citation that included a $5,000 civil penalty to Timothy Rhoads, an unlicensed individual, for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Rhoads provided two proposals for "Architectural Services" in which he offered "Architectural Design" and identified himself as an "Architect." Rhoads paid the civil penalty satisfying the citation. The citation became effective on September 12, 2007.
Luis Antonio Robles
(Pacifica) - The Board issued an administrative citation that included a $1,000 civil penalty to Luis Antonio Robles, architect license number C-21700, for alleged violations of BPC sections 5536.22 (Written Contract) and 5584 (Willful Misconduct). The action alleged that Robles commenced providing architectural services without an executed written contract. Robles provided only preliminary floor plans and exterior elevations before abandoning the project. He failed to return the client's telephone calls, causing the client to hire another architect to complete the project. Robles paid the civil penalty satisfying the citation. The citation became effective on January 26, 2006.
Gary A. Rogers
(Clovis) - The Board issued an administrative citation that included a $500 civil penalty to Gary A. Rogers, architect license number C-16583, for an alleged violation of BPC section 5536.22(a) (Written Contract). The action alleged that Rogers failed to execute a written contract when providing professional services to a client. The citation became effective on March 25, 2008.
Louis Fabian Romero
(Newhall) - The Board issued an administrative citation that included a $1,500 civil penalty to Louis Fabian Romero, an unlicensed individual, for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Romero's proposal, invoice, and business card contained Romero's business name, "Arcitex," and/or the word Architectural. Romero's company, Arcitex & Associates, is listed on the Internet under Switchboard.com as "Engineering & Architectural Services," and "Architectural Illustrators." It is also listed on SuperPage.com and Smartpages.com under "Architectural Illustrators." The citation became effective on June 7, 2006.
Administrative Actions
Ira Paul
(Brentwood) - Effective November 5, 2004, Ira Paul's architect license number C-7022 was revoked after the Board filed a Petition to Revoke Probation and adopted a Proposed Decision. The Board filed the Petition because Paul failed to reimburse the Board its quarterly investigative payments as part of the terms and conditions set forth in an earlier disciplinary decision. The earlier Decision had imposed a 180 day actual suspension of Paul's license and five years probation with specific terms and conditions. This earlier Decision was based on violation of Business and Professions Code section 5536(a) (Practice Without License or Holding Self Out as Architect).
John P. Payne
(Newbury Park) - Effective April 6, 1998, John P. Payne's architect license #C-16602 was revoked after the Board adopted a Proposed Decision ordering revocation. An Accusation was filed against Mr. Payne pursuant to Business and Professions Code sections 5583 (Fraud in the Practice of Architecture) and 5584 (Negligence or Misconduct). The action was taken based on evidence that Mr. Payne failed to detect and report the true condition of an earthquake-damaged masonry fireplace wall for a client in Los Angeles whose house had been damaged in the 1994 Northridge earthquake. In addition, he provided services without a written contract as required by law; and then filed a mechanics' lien against the property of persons who were not his clients for fees to which he was not entitled.
Wayne Eugene Penny, Jr.
(San Juan Capistrano) - Effective July 29, 1999, Wayne Eugene Penny's architect license #C-10643 was revoked; however, the revocation was stayed, his license was suspended for 90 days, and he was placed on probation for five years with specific terms and conditions, including reimbursing the Board $1,500 for investigative costs. An Accusation was filed against Mr. Penny for violations of Business and Professions Code section 5584 (Negligence). Mr. Penny was hired to perform structural calculations for a residence. The action was taken based on evidence that he failed to design to existing criteria and within the standard of care which caused a potential safety hazard.
Rodger Kent Pierce
(Austin, Texas) - Effective December 19, 2005, Rodger Kent Pierce's architect license number C-24825 was revoked. The action was the result of a Default Decision, which was adopted by the Board.
An Accusation was filed against Pierce for an alleged violation of BPC sections 490 and 5577 (Conviction of a Crime). The Accusation alleged that Pierce was convicted of attempted robbery, a third degree felony in Texas, a crime which is substantially related to the qualifications, functions, and duties of an architect.
Donald Arthur Rennie
(Anaheim) - Donald Arthur Rennie's architect license #C-18514, was suspended for six months for violations of Business and Professions Code section 5584 (Negligence or Willful Misconduct). The Board's action was prompted by Mr. Rennie's negligence resulting in substantiated financial loss and delay to his client. Mr. Rennie had agreed to design a residence for a Los Angeles couple; however, Mr. Rennie's plans were inadequate and incomplete, and he refused to complete the project despite having been paid by the client. Mr. Rennie's actions forced the clients to retain another architect to complete the project.
Mr. Rennie's license was suspended for six months and he was placed on probation for five years, effective January 16, 1998. His probation requires that he take and pass an examination administered by the Board and complete a professional education course.
Sam Rotter
(Woodland Hills) - Effective July 23, 2004, Sam Rotter's architect license, number C-29196, was revoked, after the Board adopted a Proposed Decision. An Accusation was filed against Rotter for violations of Business and Professions Code sections 5536.22 (Written Contract), 5583 (Fraud in the Practice of Architecture), and 5584 (Willful Misconduct). The Accusation was based on evidence that Rotter and his brother were potential buyers of a residence (property). Rotter, without consulting or contracting with the owner of the property for any architectural services, chose to perform site analysis and feasibility studies in anticipation of purchasing the property. The owner canceled escrow. Rotter felt that the owner "breached" her agreement with them to purchase the property and used his architectural license to file a Mechanic's Lien against the owner in the amount of $56,283.72 for architectural design drawings. This caused the owner financial harm by encumbering her property and preventing her from selling it.
