Citations
Ben B. Safyari
(Los Angeles) - The Board issued an administrative citation that included a $1,000 civil penalty to Ben B. Safyari, an unlicensed individual for alleged violations of BPC sections 5536(a) and 5536.1(c) (Practice Without License or Holding Self Out as Architect). The action alleged that Safyari entered into a contract and then prepared, drawings for a six-unit apartment building, a non-exempt project. The citation became effective on April 17, 2006.
L. Carlos Salgado
(Glendale) - The Board issued an administrative citation that included a $1,000 civil penalty to L. Carlos Salgado, an unlicensed individual for violations of Business and Professions Code section 5536(a) (Practice Without License or Holding Self Out as Architect). This action was taken based on evidence that Salgado prepared a written proposal to provide design services for an 8-unit apartment building, which is a non-exempt structure. Upon contacting Salgado by telephone, a recording stated, "You have reached Architect Building Design." The telephone recording stating the term "Architect" misrepresented to the public that Salgado is an architect or qualified to engage in the practice of architecture. The citation became effective on October 25, 2004.
Marilou Samson
(San Francisco) - The Board issued an administrative citation that included a $500 civil penalty to Marilou Samson, an unlicensed individual, for violations of BPC sections 5536(a) and 5536.1(c) (Practice Without License or Holding Self Out as Architect). The action was taken based on evidence that Samson entered into a contract to prepare "As-built plans, Design Development Drawing requirements for the application of City Planning Variance," and then performed the design development phase work for a three-story building over a garage, which is a non-exempt project. Samson paid the civil penalty satisfying the citation. The citation became effective on April 27, 2005.
India Laurel Sandek
(Big Bear Lake) - The Board issued an administrative citation that included a $300 civil penalty to India Laurel Sandek, architect license number C-18299, for a violation of Business and Professions Code section 5536.22 (Written Contract). This action was taken based on evidence that Sandek commenced preparing drawings for a remodel/addition to a residence without having an executed written contract for professional services. Sandek paid the civil penalty satisfying the citation. The citation became effective on July 23, 2004.
Thomas J. Schoustra
(San Diego) - The Board issued an administrative citation that included a $1,500 civil penalty to Thomas J. Schoustra, an unlicensed individual, dba Grace & Associates, L.T.D., for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Schoustra put out a written proposal, a business card and an invoice with the word "Architectural" and identified Schoustra as an "Architect." The citation became effective on October 15, 2007.
Stephen G. Shackelton
(Encinitas) - The Board issued an administrative citation that included a $1,500 civil penalty to Stephen G. Shackelton, an unlicensed individual for violations of Business and Professions Code sections 5536(a) (Practice Without License or Holding Self Out as Architect) and 5536.1(c) (Unauthorized Practice). This action was taken based on evidence that Shackelton put out several devices that read "Stephen Shackelton, Architect" and "Shackelton Architecture Company." Shackelton also prepared plans for a professional office building, which is a commercial non-exempt structure. Shackelton paid the civil penalty satisfying the citation. The citation became effective on August 24, 2004.
Tim A. Shaeffer
(Redlands) - The Board issued an administrative citation that included a $500 civil penalty to Tim A. Shaeffer, an unlicensed individual, for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Shaeffer executed a written contract offering "Architectural Design." The citation became effective on September 24, 2007.
Simon Tak-Wong Shum
(Walnut) - The Board issued an administrative citation that included a $750 civil penalty to Simon Tak-Wong Shum, architect license number C-22647, for alleged violations of BPC sections 5536.22(a) (Written Contract) and 5584 (Willful Misconduct). The action alleged that Shum failed to include statutorily required language in a written contract for providing professional services. Shum also billed for the planning phase prior to completion, which was contrary to the contract. Shum paid the civil penalty satisfying the citation. The citation became effective on July 18, 2006.
Scott A. Spencer
(La Jolla) - The Board issued an administrative citation that included a $2,500 civil penalty to Scott A. Spencer, architect license #C-12989, for violations of Business and Professions Code section 5536(a) (Practice Without a License or Holding Self Out as Architect). Mr. Spencer's license expired on May 31, 1987 and has not been renewed. This action was taken based on evidence that Spencer prepared plans which bore a title block that read "Scott A. Spencer & Associates Architecture Planning." The plans bore a stamp that read "Licensed Architect," "Scott A. Spencer," "No. C 12989," the legend "State of California," and his signature. Mr. Spencer used a written contract which contained the term "Architectural" throughout, he put out a business card containing his name and advertised that he provides "Architectural Design," and put out letterhead stating "Scott A. Spencer Architect." In addition, Mr. Spencer is listed in the Smart Yellow Pages as "Scott Spencer Architect" under the "Architects" heading. Mr. Spencer paid the civil penalty satisfying the citation. The citation became effective on May 10, 2004.
Charles John Staff III
(Los Angeles) - The Board issued an administrative citation that included a $750 civil penalty to Charles John Staff III, architect license number C-22189, for an alleged violation of BPC section 5536.22(a) (Written Contract). The action alleged that Staff was hired to design an addition and remodel of a residence. He failed to finalize terms and to obtain the client's signature on a written agreement prior to commencing his professional services on the project. The client believed Staff was to provide construction observation, however, since there was no executed agreement, site observation services and/or responsibility for providing them was ultimately disputed. Due to alleged defects in the construction of the project, the client initiated arbitration proceedings against the contractor and Staff, which resulted in a settlement and mutual release agreement, with Staff paying $40,000 and the contractor paying $510,000. Staff paid the civil penalty satisfying the citation. The citation became effective on January 24, 2008.
William Raymond Stonebreaker
(Rancho Santa Fe) - The Board issued an administrative citation that included a $500 civil penalty to William Raymond Stonebreaker, architect license number C-10952 (expired), for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that while Stonebreaker's license was expired, he gave his client a business card that stated "WM. STONEBREAKER, A.I.A., ARCHITECT" which was a device that indicated to the public that he was an architect or qualified to engage in the practice of architecture. The citation became effective on April 26, 2006.
Addison Strong
(San Francisco) - The Board issued an administrative citation that included a $500 civil penalty to Addison Strong, an unlicensed individual, for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). This action alleged that Strong's contract offered "Architectural Services" and included the word "Architect." The citation became effective on January 16, 2007.
George Sumney
(Fontana) - The Board issued an administrative citation that included a $1,500 civil penalty to George Sumney, an unlicensed individual, for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). This action alleged that Sumney was identified as the "Architect" and included the word "Architecture" on his contract and business card. This action also alleged that Sumney was listed under the "Architects" heading on the Internet. The citation became effective on December 12, 2006.
Cecil W. Swason
(Plymouth) - The Board issued an administrative citation that included a $1,000 civil penalty to Cecil W. Swason, architect license number C-8991, for an alleged violation of BPC section 5536.22 (Written Contract). The action alleged that Swason failed to execute a written contract when providing professional services to a client. Swason paid the civil penalty satisfying the citation. The citation became effective on August 17, 2007.
Leonard Navin Temes
(West Hollywood) - The Board issued an administrative citation that included a $1,000 civil penalty to Leonard Navin Temes, an unlicensed individual, for alleged violations of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). This action alleged that Temes executed an "AIA Document B141 Standard Form of Agreement Between Owner and Architect" to provide design services for a master bedroom and bathroom. Temes is designated as the "Architect" in the agreement. In addition, Temes' Web site stated, "With 20 years of experience, Temes enjoys his work as a furniture and interior designer as well as an architect." The citation became effective on November 7, 2006.
Michael Dean Thomas
(Oakland) - The Board issued an administrative citation that included a $500 civil penalty to Michael Dean Thomas, architect license number C-5924, for an alleged violation of BPC section 5584 (Misconduct). The action alleged that Thomas did not pay one of his sub-consultants as required by the contract. The citation became effective on April 26, 2006.
Franklin Wilberforce Thornton
(Arcadia) - The Board issued an administrative citation that included a $500 civil penalty to Franklin Wilberforce Thornton, architect license number C-5522, for an alleged violation of BPC section 5536.22 (Written Contract). The action alleged that Thornton commenced providing architectural services by developing ideas for a property, without an executed written contract. Thornton paid the civil penalty satisfying the citation. The citation became effective on January 18, 2006.
Matthew Trujillo
(Panorama City) - The Board issued an administrative citation that included a $2,500 civil penalty to Mathew Trujillo, an unlicensed individual for an alleged violation of BPC section 5536(a) (Practice Without License or Holding Self Out as Architect). The action alleged that Trujillo was listed under the "Architects" heading on the Internet at Yellowpages.com. The citation became effective on October 12, 2007.
Kilifi H. Tulikfanga
(Menlo Park) - The Board issued an administrative citation that included a $500 civil penalty to Kilifi H. Tulikifanga, an unlicensed individual for a violation of Business and Professions Code section 5536(a) (Practice Without License or Holding Self Out as Architect). The action was taken based on evidence that Tulikifanga executed a written proposal to provide "architectural" plans to obtain a permit for an extension to an existing porch. The letterhead on the proposal contained Tulikifanga's name and firm entitled "Architectural & Carpentry Works." The citation became effective on October 1, 2004.
Robert Ladd Turek
(San Diego) - The Board issued an administrative citation that included a $500 civil penalty to Robert Ladd Turek, architect license #C-7806, for a violation of Business and Professions Code section 5584 (Negligence). This action was taken based on evidence that Mr. Turek wrote a letter to the County of San Diego Code Enforcement Division advising that he had inspected a Keystone retaining wall and found it to be well-constructed and following the specifications provided by the manufacturer. According to his own statement, Mr. Turek was not present when the wall was originally constructed, was not told that the wall had fallen following construction and was not present when the wall was reconstructed. Mr. Turek failed to use the care and skill ordinarily used by a reasonably prudent architect practicing under similar circumstances, which constituted negligence. Mr. Turek paid the civil penalty satisfying the citation. The citation became effective on March 25, 2004.
Antony M. Unruh
(Los Angeles) -The Board issued an administrative citation that included a $500 civil penalty to Antony M. Unruh, architect license number C-26012, for an alleged violation of BPC section 5536.22(a) (Written Contract). The action alleged that Unruh commenced providing professional services for a residence without an executed written contract. Unruh paid the civil penalty satisfying the citation. The citation became effective on August 3, 2006.
Administrative Actions
Curtis Shupe
(Palm Desert) - Effective January 13, 2007, Curtis Shupe's architect license number C-13388, was revoked; however, revocation was stayed. Shupe's license was suspended for 90 days, and he was placed on probation for five years with specific terms and conditions, including restitution pursuant to an arbitration award to the clients in the amount of $63,876.36. The action came after a stipulated settlement was negotiated and adopted by the Board.
An Accusation was filed against Shupe for alleged violations of Business and Professions Code (BPC) sections 5584 (Negligence or Willful Misconduct) and 5589 (Malpractice Settlement or Arbitration Award). The Accusation alleged that Shupe failed to provide observation services as called for on the project as follows: He authorized payment of the contractor's invoices for the roof system, including skylights, related materials and work, despite the fact that these items as completed by the contractor did not conform with the contract documents and applicable industry and trade standards. An arbitration award was issued against Shupe, which he failed to report to the Board.
Jeffrey Stanton Sulkin
(Santa Monica) - Effective August 1, 2000, Jeffrey Stanton Sulkin's architect license #C-20501 was revoked; however, the revocation was stayed, his license was suspended for 180 days and he was placed on probation for six years with specific terms and conditions, including reimbursing the Board $6,000 for its investigation and enforcement of the case. The action came after a stipulated settlement was negotiated and adopted by the Board. Mr. Sulkin admitted in the settlement that he was guilty of fraud or deceit in violation of Business and Professions Code section 5583.
On August 18, 1996, Mr. Sulkin entered into a contract to design a new single-family residence, as well as site improvements that were to be constructed on the site of a current residence in Brentwood, California. On March 21, 1997, the clients paid Mr. Sulkin $4,500 to cover plan-check fees after being informed by Mr. Sulkin that he would forthwith thereafter submit the plans to the building department for plan-check. Through-out April and May into June, 1997, Mr. Sulkin more than once told the clients that their plans were moving along, and they wrote and delivered to Mr. Sulkin another check for $1,400 for a street frontage survey for the city plan-check department. On July 22, 1997, the clients and others met with Mr. Sulkin. At the meeting, Mr. Sulkin admitted that he never submitted the plans to the building department for plan-check.
James Preston Sutton
(Diamond Springs) - An Accusation was filed against James Preston Sutton for violations of Business and Professions Code sections 5536(a) (Practice Without License) and 5584 (Negligence or Willful Misconduct). The Board took the action based on evidence that Mr. Sutton failed to provide services or complete documents which he contracted to provide, refused to stamp or sign documents as required by the building department for plan check and permits, and willful misconduct in that he billed for and demanded payment for services which he had not performed. The Board adopted a stipulated settlement. Terms of the settlement included a stayed revocation with five years probation and a six months actual suspension and requirements that Mr. Sutton take and pass the Board's oral examination and reimburse the Board $3,000 of its investigative costs, as well as other standard terms of probation, effective November 3, 1997.
Garry Ray Terwilliger
(Yucaipa) - Effective December 22, 2005, Garry Ray Terwilliger's architect license number C-21148 was revoked. The action was the result of a Default Decision, which was adopted by the Board.
An Accusation was filed against Terwilliger for alleged violations of BPC sections 5536(a) (Practice Without a License or Holding Self Out as Architect), 5536.5 (State of Emergency; Practice Without License or Holding Self Out as Architect), 5583 (Fraud in Practice of Architecture), and 5584 (Willful Misconduct). The Accusation alleged that while his license was expired, Terwilliger executed a written contract to provide architectural services and offered to provide architectural services for a residential structure that was damaged by a natural disaster for which a state of emergency was proclaimed by the governor. He also failed to provide any service to the victim after receiving a deposit, failed to refund deposits, and failed to satisfy a small claims judgment.
Respondent renewed his delinquent license, and in another project, received a deposit to provide architectural services. He failed to provide a complete plan, failed to complete and/or make corrections to the plans, and abandoned the project.
Daniel J Tonnemacher
(Incline Village) - Effective October 31, 1997, Daniel J. Tonnemacher's, architect license #C-10227 was revoked after the Board adopted a Proposed Decision ordering revocation. An Accusation was filed against Mr. Tonnemacher pursuant to Business and Professions Code section 5586 (Public Agency; Disciplinary Action). The action was taken after it was determined that the Nevada State Board of Architecture, Interior Design and Residential Design revoked Mr. Tonnemacher's Nevada architect license for acts of incompetence and negligence in the practice of architecture that resulted in substantial financial loss and delay to his clients and failure to disclose that he had been found guilty by a trial court of violating the law.
