Common Violations of the Act: Business Entity Reporting Requirement

Many licensees have not filed the proper and current name and address of each business entity through which they provide architectural services with the Board, as required by BPC 5558. Additionally, licensees often fail to immediately notify the Board of any changes to the name or address of the business entity through which they provide architectural services.

Licensees should comply with this requirement by completing a Business Entity Report Form (BERF) and mailing, faxing, or emailing it to the Board. Additionally, the Board must be notified of any and all changes to BERF elements within 30 days after any change. This reporting requirement provides the Board and the public with a means to determine if a business offering or providing architectural services does in fact have an architect in responsible control of those services.
